Today, the full Fifth Circuit announced that the far-right judges of the court LOST a vote for rehearing en banc 8-9 after a 3-judge panel had previously upheld the dist ct's injunction.

On Tuesday, Dick Durbin pushed back against the “baseless and bigoted attacks” being faced by Third Circuit nominee Adeel Mangi. Good for him.

Trump will get nearly every break the system can give him because he is an elite with money (if a questioned amount) and power (if a questioned amount). The majority gives no reasoning; Barrett, joined by Kavanaugh, gives an embarrassingly absurd *this is just an administrative stay* concurrence; Sotomayor, joined by Jackson, is extremely unhappy in their dissent (below); and Kagan respectfully dissents as well.

NEW: DOJ has gone to SCOTUS over the 5th Circuit's "administrative stay" in the Texas SB4 immigration case that would allow the law to be enforced starting March 10. DOJ wants the district ct injunction against SB4 to remain in effect, blocking the law. https://www.documentcloud.org/documents/24455809-23a814

Although nothing is certain with SCOTUS, it is sensible for all of us to prepare for the Trump Fourteenth Amendment ballot case out of Colorado to be the ruling we get at 10 a.m. Monday.
