Because whilst distinguishing training from use as regards copyright is meaningful nuance, it completely occludes the fact that use was made widely available before the conditions of training were known?

I don't recall saying anything about intent. It's as @kitten_tech said. Ethically, machine learning needs training data. The labour to produce not being acknowledged is an issue.

Ultimately, i'll say the line again: 'ethical genAI use' is like 'fairtrade cocaine': the words can be strung together, and the concept thus signified could notionally exist.

In practice, it's a non-starter, without a change in the production and consumption of these products so drastic it's fantasy.
