Legal regulations lay down the requirements that e-cigarettes must meet to be legally marketed, including disposable e-cigarettes, which are particularly popular among young people. In 2022, as part of official control activities across various federal states in Germany, the compliance with these legal requirements was assessed in 250 disposable e-cigarettes with regard to conformity/marketability. In addition to labelling (nicotine content, fill volume/number of puffs, nicotine warnings, package inserts, labelling of hazardous substances), product safety (child safety), aspects of consumer deception, and compliance with the reporting obligation in the EU Common Entry Gate were examined. None of the disposable e-cigarettes analysed met the criteria for marketability, as considerable deficiencies were identified in at least one of the aforementioned criterias.
