However, this statute of limitations does not apply to many immigration offenses because the offenses are seen as continuing beyond the initial date of action. For example, in United States v. Krstic, 558 F.3d 1010 (9th Cir. March 10, 2009), the Ninth Circuit held that the crime of possessing an authentic immigration document obtained by means of a false statement was a possessory offense, rather than a false statement offense. 18 U.S.C. 1546(a). As a possessory offense, it was a continuing offense and the statute of limitations began to run only when federal agents seized the authentic immigration document."
