Emeritus Prof Christopher MayAfter 25 years research & analysing intellectual property I concluded the form with the highest likely social benefit was the trademark for exactly the reasons you suggest.... other forms had some advantages & disadvantages (sometimes more of the latter), but for the most part TMs were in my view a social good (not above miss-use of course)
