The 13th and 14th amendments were passed under duress. The southern states were forced to pass them or be denied representation in Congress and they were occupied by a military force that interfered with elections. The text also says "subject to the jurisdiction thereof" and did not always apply to foreigners here illegally. It didn't even apply to Indians until the 20th century.
