Once a ruling is issued, two additional things will happen. First, the City Attorney can request a stay pending appeal so that the tax can be collected. Second, the City is expected to file an appeal to request that the Court of Appeal reverse the trial court and uphold the Empty Homes Tax.Once the landlord lobby challenged the law, we knew the fate of the law would ultimately be decided on appeal, regardless of the trial court decision. Had the judge ruled in favor of the city, the landlord lobby would have appealed. With the judge ruling in favor of the landlords, the City will appeal. While we would have preferred a trial court ruling upholding the law, the appellate court review on the legal issues will be de novo.</a></label><br><a href="https://files.sfba.social/media_attachments/files/113/420/552/199/802/841/original/e79e8c4d881d9750.jpeg" rel="external">https://files.sfba.social/media_attachments/files/113/420/552/199/802/841/original/e79e8c4d881d9750.jpeg</a></li><li><label><a rel="external" href="https://gnusocial.jp/attachment/3404893">This is the strongest vacancy tax in the nation– most notably because it taxes vacant homes per unit, instead of per parcel, a contrast with Oakland.  The law is carefully crafted with exceptions for any good faith vacancy, while targeting the hoarding &amp; purposeful prolonged vacancies largely conducted by real estate speculators who are more interested in buying, holding, &amp; selling empty units than providing homes. We expect the law to be upheld on appeal, although we will not know the results of the appeal for some time. We recognize that this is disappointing for the thousands of activists who united behind the Empty Homes Tax. The DSA SF Chapter and Faith in Action Bay Area in particular worked tirelessly to pass this ballot measure. We were proud to pave the way with our groundbreaking residential vacancy report, comparative analysis of other vacancy taxes, public hearings, &amp; other advocacy. SF’s groundbreaking Empty Homes Tax is a powerful tool to fill thousands of vacant homes being hoarded/held off the market by real estate investors in SF, while raising money from those who persist in holding units off the market with no good reason to fund rental subsidies &amp; acquisitions of vacant properties for affordable housing. We’re optimistic that the Court of Appeal will follow the will of the voters and uphold the Empty Homes Tax. In the meantime, owners of multi-unit buildings are encouraged to activate their units, not just because it’s the right thing to do, but because vacancies today are likely to result in a significant tax bill. So long as people are priced out of our housing market &amp; forced to live on the streets &amp; in shelters, we will continue doing everything possible to fill empty homes.
