Charles Synyard@icedquinn When the offense was something like what the lawmaker, or at least a reasonable person, was trying to prevent or would have understood as needing to be prevented. This goes back to an insight by Robert Filmer. No matter how good a set of laws may be, they can always turn oppressive unless the ruler is able to arbitrate and decide which cases count as exceptions.
