The Advocate General opined that under Article 16 GDPR a transgender data subject has the right to rectification of their inaccurately recorded gender in the asylum register. While the authority can ask the data subject to prove the inaccuracy, it cannot ask them to prove they have undergone gender reassignment surgery.
