I've published an essay that begins to sketch the legal thinking necessary for what I refer to as "non-reformist media reforms". Ultimately, we must make the case for affirmative policy interventions that prioritize our informational and communicative needs over capitalist imperatives and libertarian logics. This requires building a public service media (independent, participatory, democratic) system based on a positive-rights paradigm.
