Nintendo is suing the people behind the Yuzu emulator.
The lawsuit appears to have two arguments at it's core:
1) Yuzu is an emulator, and emulators facilitate piracy. Therefore, Yuzu is illegal as all emulators should be illegal.
2) Yuzu has instructions on their site to dump the system keys from modified switch. These instructions tell you how to bypass a digital lock, and thus are illegal under the DMCA.
The first argument is the most dangerous one, and I'm hoping it just gets dismissed as the Sony vs Bleem precedent appears to contradict this argument.
The second argument is different, and I think might have a better chance of a ruling in Nintendo's favor.
