there is legal merit in lending books that arent available digitally, and if the publishers tried to get them to stop lending scans of books that cant be bought anymore then they would probably lose (as the financial damage would be nothing, no market substitute and the beenfit to the public is obvious). books that can still be bought (but are not on overdrive) is another legal grey area but im guessing the legal cost and bad press arent worth it for something that doesnt create enough profit to be worth digitizing/selling.
