Most appeals are brought after the trial.
Some issues must be resolved before the trial. Claims of immunity are among them because if you are immune, you don't have to go through a trial.
As far as I can see, only the 7th and the 9th circuits devised a procedure for handling this (because it doesn't come up often).
We can assume but we don't know for sure that the DC circuit will follow the same procedures.
