Well, not exactly. It's called court for a reason. It's not "just" an ethical comission or some philosphers' debating society.
The point is that the European Court decision is surpassed by national legislation of the EU member states.
But data retention and backdooring citizens' computers both have been outlawed by the German supreme court (Bundesverfassungsgericht), too. The former for several times already.
