I really think there could be a prep act exception to immunity. He literally said that the mass production process didn't follow the same protocols as the trial vaccine. They knew there was dna in the end product and tried to hide it. They knew or should have known the risk of transcription. And they used trials that didn't account for the risk inherent in the end product. Intentional or reckless conduct is an exception to prep act immunity.
