- Embed this noticePrior to modern society people could still be killed, but there was no crime of murder. No trial, no evidence etc. Without a state to enforce laws one of two things happened. Either a) vengeance or b) nothing. There was no NAP or other gobbledigook.
The same was true of stealing. The strong took from the weak, likely by killing first and it wasn't a crime, it just was what it was. The state exists to determine what is right and wrong within a society. Supposedly it reflects the values of that society but often it doesn't. It is however the sole determinant of what is and isn't illegal. Theft is a crime. The govt determines what is and isn't a crime and the govt taxes you. Taxation testing has been through every court in the USA and determined to be legal.
