@taiyo I’m a competition lawyer but what are you referring to by “UCA”? I assume “Unfair Competition Act” but that’s not US competition law.
@YoWatShiina Isn't Unfair Competition Act a federal law?
@taiyo No. The main pillars of the competition laws in the United States on the federal level include Sherman Act, Clayton Act, the FTC Act, and Robinson-Patman Act. Competition laws protect market competition. Although Musk’s conducts are dicky, I don’t see any anticompetitive concerns (except that TW may not now have wherewithal to comply with FTC’s consent decree but that’s another story)
@YoWatShiina Thanks for telling a set of competition law.
I’ve pointed about Twitter misinformed Mastodon as “harmful web” on their link management. This reminds me NetScape shown IE as malware, which was treated as anticompetitive action.
@taiyo So here’s some comments from antitrust experts. It is possible for the FTC to get interested (b/c the current Chair, Lina Khan, tends to take a novel approach & also b/c FTC Act is broader) but they would still neeed to prove TW has market power, which requires definition of the market, and it’s going to be tough b/c FB has a much bigger user base.

@taiyo Addttionally, the article is misleading because a business generally has no duty to deal with its competitors (even in the case of a monopolist, which a regulator has a tough time to argue that TW is, b/c of the market definition problem as stated above).
Here’s a summary by the FTC about the refusal to deal:

@YoWatShiina I understand what you mean. It seems hard to hit with competitive law.
