Before I get into Hendrix's opinion, a reminder about why class certification matters. Venezuelans detained per Trump's invocation of the Alien Enemies Act are scattered throughout the country, in various DHS/ICE facilities. Many detainees are not able to contact or find a lawyer. They remain nameless for litigation purposes. 3/

What class certification does for these nameless Venezuelans is give them legal representation - a means of pursuing their habeas corpus petitions even though they can't personally contact or obtain lawyers. Also, crucially, by being included in such a class, they can be protected from unlawful removal from the country by Trump's DHS/ICE while habeas proceedings unfold. 4/
