I want to make sure people know that in the U.S. a Presidential executive order is not a law. It is an internal memo from the head of the Executive to others in that branch. The President has no constitutional authority to legislate or adjudicate the law. 1/

In any event, if a President issues an executive order to other executive branch official directing them to do unlawful or unconstitutional things, the order is legally empty. Of course, an empty EO can still wreak havoc. 3/

Nobody, other than executive branch officials, is obliged to do anything at all just because of something a President says in an executive order. 4/

Again, I don’t know if Trump knows or understands this. I am confident that whatever he knows about the actual force of an EO, he loves that they are called orders. He is also a master of using social media to give the impression that they are laws. 5/5
