Trump “further direct[s] the Attorney General to take all appropriate action to refer for disciplinary action any attorney whose conduct in Federal court or before any component of the Federal Government appears to violate professional conduct rules, including rules governing meritorious claims and contentions, and particularly in cases that implicate national security, homeland security, public safety, or election integrity.” 4/
Trump’s threats against lawyers goes after partners in law firms, directing that they are to be sanctioned for the conduct of associates who litigate against the Trump executive branch. Many associates who work in large law firms fulfill their pro bono obligations by volunteering with public interest organizations. Trump is trying to shut this down. 5/
Finally, Trump orders all manner of investigation into firms that have litigated against the executive branch during the “past eight years” so that the DoJ can recommend to him which firms and individual attorneys should have their security clearances yanked. 6/
It is rich that Trump’s memo threatening all law firms who represent clients in cases against his regime carries on about Federal Rule of Civil Procedure Rule 11, https://www.law.cornell.edu/rules/frcp/rule_11, which requires attorneys to be reasonable and honest in their filings in court. The Trump DoJ, headed by Bondi, has been violating this rule multiple times daily for weeks now. 2/
Trump has ordered DoJ and DHS to “seek sanctions against attorneys and law firms who engage in frivolous, unreasonable, and vexatious litigation against the United States or in matters before executive departments and agencies of the United States.” 3/
