one of my repeated topics is "cruel AND unsual" punishment; in that their reasoning was that for the punishment to be wrong it has to meet both tests. This way it prevents a special punishment to someone with who a judge has a personal animus

@WaughheadRex well, and more critically laws have been changed so people on the street can't be removed until they are committing crimes.

@sickburnbro ignore person lying in their own filth and refuse on a public thoroughfare. said person is interfering with others, endangering health of others, and is only kept alive by the charity and tolerance of others, not to mention the elimination of natural predators. some process that doesn't currently exist has to be applied to such people. the ruling is only making that more clear.
