You’ve probably heard about The New York Times lawsuit against OpenAI. But the details are impressive: The NY Times provided 100 exhibits of ChatGPT completing articles almost word for word, and the suit seeks the deletion of all GPT models.

Could it succeed, and what would be the consequences? I spoke with general counsel Cecilia Ziniti and Techdirt editor @mmasnick about its chances.

@ruedigergad @dgavin @mattontech the entirety of this discussion ignores fair use. Also, no, it is not "stealing." Nothing is lost. It's not even copying. It's reading.

@dgavin @mattontech @mmasnick as you say, it's "stealing", which is illegal.
As a software developer, one very important thing is licensing. Only when a license explicitly allows re-using/"copying" code it's ok to copy. There are even many more nuances. However, one point is that if there is no license mentioned granting rights, the work has to be considered as proprietary. Also, I'd expect entities like NYT to have strict licenses actively restricting the use of their work.

@mattontech @mmasnick I gave my first WWW courses to teachers in 1998. First thing I told them: if you put something on the web, you loose control over it. Don‘t come back whining afterwards if you publish free things for all the world to see and someone steals it.
Seems the NYT needs an "Internet 101" introduction. From 25 years ago.
