Does Canada allow defenses based on the unlawfulness of an order in cases of alleged contempt. Is that the underlying issue? Are the police afraid he'll mount a successful defense if they charge contempt? Can a private citizen enforce contempt if the government won't, e.g. is civil contempt available to a business owner or patron? Does res judicata or collateral estoppel apply in such cases?

I'm not Canadian, though I assume Canada has some commonalities with US Law given our common roots. Rather than sitting around waiting for the police to act, I'd start exploring other options. I thought I throw out a few legal ones to explore, while refraining from fedposting.
