All of NHS Scotland's 14 health boards have been accused of breaking the law by not having any single-sex facilities policies, especially in the wake of the Supreme Court's ruling on Wednesday. A series of freedom of information requests by a campaigner unearthed these "disgraceful" details.
All public bodies, as well as the Scottish Government, have produced policies which allow trans people to self-identify and use the bathroom or changing facilities they identify with. This may have to be ripped up as a result of judges unanimously ruling that the definition of a woman and sex in the Equality Act relates to “a biological woman and biological sex."
Campaigner Peter Todd supplied a dossier of freedom of information requests which revealed that all 14 health boards didn't have any guidance surrounding single-sex facilities. None of the bodies have a policy they stick by for single-sex changing, toilets and showering.
One of the 14, NHS Ayrshire and Arran, said it has no communal changing facilities and only provides individual ones for parents. Rebel SNP MSP Fergus Ewing lambasted these revelations, writing on X: "Revelations today that not a single health board in Scotland has a policy for single sex changing rooms is shocking - and illegal. The Scottish Government must address this and issue orders to fix it. They have the legal powers to do so."
