As widely documented by legal scholars, the Constitution gives the people, through Congress, the power to correct excessive overreach by the Supreme Court. Article lll, Section 2, Clause 2 of the Constitution empowers Congress to create "exceptions” and “regulations” to the appellate jurisdiction of the Supreme Court. Anyone who says that Congress does not have the power to oversee the Supreme Court, as Justice Samuel A. Alito Jr. has suggested, has either not read or has ignored the plain language of Article lIl.
