Abbotts position is extreme under today's jurisprudence and I'm not sure a court would agree because of the legal precedent it would set. (I'm not saying he's wrong though).

Abbott's argument at base is that immigration law is statutory, and therefore, inferior to the constitutional provision regarding a states authority to protect itself from invasion, including invasions caused by immigration law itself.
