@helene@p.helene.moe if i recall correctly (and i am not a lawyer) in german law there is a slight difference between a Lichtbildwerk (lit. light painting work) and a Lichtbild (lit. light painting).
the former has "higher value" in a way, as it satisfies the attribute of being a work and is protected as other works (i.e. until authors death + 70 a), where as the latter is more of a snapshot and is less protected (i.e. publication or manufacture + 50 years)
https://www.gesetze-im-internet.de/englisch_urhg/englisch_urhg.html#p0657 was originally based on directive 93/98/EWG, so maybe france has something similar
