Plus, 1A literally regulates congress, so states would have a better chance given the nebulous "incorporation doctrine" used to apply 1A against the states under 14A (note that Sullivan still allows states to prohibit defamation). -

However, congress has a poor record of respecting the bounds set by the bill of rights. There are no penalties for passing a bad bill. In addition to that, the judicial system doesn't exactly have a very good record of enforcing the bill of rights. The judicial system has been filled with activists from the top-down.
