     I don't see how it's any different tbh. Plus, 1A literally regulates congress, so states would have a better chance given the nebulous "incorporation doctrine" used to apply 1A against the states under 14A (note that Sullivan still allows states to prohibit defamation).

     They're boosting the stupid Swift AI story for a reason. The angle might be to thread-the-needle for AI legislation. They could argue that AI is in a different category than previous cases that have been argued.

     Your argument is solid. However, congress has a poor record of respecting the bounds set by the bill of rights. There are no penalties for passing a bad bill. In addition to that, the judicial system doesn't exactly have a very good record of enforcing the bill of rights. The judicial system has been filled with activists from the top-down. They're always looking for an outlier-case to hang a decision on.
